LHRC and TSNP file a case against HESLB to challenge unwarranted increase of loan repayment rate

On 2^ndApril, 2017 the Legal and Human Rights Centre (LHRC), in collaboration with the Tanzania Student Networking Program (TSNP), filed a constitutional case at the High Court of Tanzania on behalf of ShukuruMlwafu, who is the main complainant. The case has been filed to challenge Section 20 (1b) of Higher Learning Education Students Loans Board Act, which infringes the Right to Own Property as provided under Article 14 of the Constitution of the United Republic of Tanzania.

Speaking before members of the press congregated at the High Court of Tanzania, the LHRC’s PasienceMlowe said “LHRC and TSNP have joined hands to support the petitioner in filing a case because it is of public interest given that most of the educated Tanzanians are victims of the increaseof loan repayment ratefrom 8% to 15% by HESLB.

The petitioner, Mr. ShukuruMlwafu,revealed the reason behind filing of the case to be seeking the Court’s opinion and interpretation of the amended provisions on loan repayment rate. He further insisted that a move should not be interpreted as an attempt to prevent HESLB beneficiaries from repaying loans but rather to call for justified repayment rate.
